Creditors Rights

Most businesses have issues regarding collections and must deal with debtors who refuse to pay for services and/or products.   Such debtors may seek protection from their obligations by filing for bankruptcy. The offices of Robert J. Malloy, Esquire can assist a business and its debtors to resolve the outstanding debts efficiently, even when the debtor files for bankruptcy.

We understand that debt collection and bankruptcy issues can be confusing and complex.  The offices of Robert J. Malloy, Esquire offer comprehensive counseling to individuals and businesses, who are creditors in all collection matters. We offer a wide range of debt collection services.  Our services may include sending a demand letter,  negotiating with the debtor, and if necessary filing legal action to secure a judgment against the debtor. Each collection matter is unique and our office appropriately follows collection protocols in compliance with Federal and State Consumer Protection law, including the Fair Debt Collection Practices Act (FDCPA).

In some cases, the debtor has filed for bankruptcy.  The offices of Robert J. Malloy, Esquire offers a wide scope of legal representation to clients, who are creditors in all bankruptcy matter including Chapters 7, 11 and 13 bankruptcies. Our office has represented businesses, mortgage holders, banks, non-debtor spouses and secured and unsecured creditors in bankruptcy proceedings to collect the outstanding debt.

Generally, the first step is to send a letter to the debtor, requesting payment and/or a negotiated settlement.  In some cases, we are able to reach a settlement with the debtor.  If the debtor does not respond within the deadline provided, or a settlement is unable to be reached, our office will file a collection lawsuit to secure and enforce a judgment against the debtor.

If the debtor files for bankruptcy, our office will be:

  • your advocate in all hearings and proceedings.
  • Your liaison with the bankruptcy trustee, debtors and debtors’ attorneys, seeking to resolve your claim.
  • Your advocate with the bankruptcy trustee for any “preference” claims.

Our office also offers:

  • Creditors’ issues in foreclosure matters.
  • Collection of commercial debt, secured or unsecured, for large and small businesses, banks, lenders, commercial landlords and equipment leasers.
