Most businesses have issues regarding collections. They may be the ones who are owed money or the ones who owe money. It is the basis of many disputes. This is an area in which we can assist an entity to resolve the issues efficiently, especially when the borrower files for bankruptcy.
We represent creditors who are attempting to collect debts. We handle all communications and negotiations with the debtor. In some cases, a settlement can be reached without the need to file a lawsuit. We will attempt to reach a payment agreement, in order to satisfy the debt.
Sometimes, it is necessary to file a lawsuit to obtain a judgment against the debtor. In some cases, the debtor has filed for bankruptcy. Our office can represent the creditor in a bankruptcy and help them to collect on their debt.
Generally, the first step is to send a letter to the debtor, requesting payment. In some cases, we are able to reach a settlement with the debtor. If the debtor does not respond within the deadline provided, or a settlement is unable to be reached, the next step may be to file a collection lawsuit.
If a settlement cannot be reached, a lawsuit may be filed. Our office will represent the creditor in the lawsuit in an attempt to obtain a judgment against the debtor. If the court rules in favor of the creditor, and a judgment is entered against the debtor, we will help the creditor with the steps needed to be taken to collect on the judgment.
